Madera Casino Future Placed at Risk by Court Ruling
This week the California Fifth District Court of Appeals dealt a critical blow to the future of the North Fork Mono Casino project in Madera. The court ruled the state's approval to build the casino is no longer valid.

The North Fork Mono Casino has been under construction since Sept. 2024 with a grand opening expected this coming summer in 2026. The North Fork Rancheria tribe planned to start hiring over 1,000 casino workers beginning within the next few months. The appellate court made the ruling in a lawsuit against the North Fork Rancheria Band of Mono Indians filed by the Picayune Rancheria of the Chukchansi Indians, which owns the Chukchansi Gold Resort & Casino located in Coarsegold about 36 miles northeast of the North Fork Mono Casino construction site.
CASE SUMMARY
In 2011 the federal government authorized the North Fork Mono Casino could be built on off-reservation land north of Madera. The off-reservation location required concurrence by the state governor.
In 2012 former California Gov. Jerry Brown concurred with the Madera location and signed a gaming compact with the North Fork Rancheria.
In 2013 the tribal-state compact was ratified by the California Legislature.
In 2014 California voters passed Proposition 48, which rejected two state-approved gaming compacts. The North Fork Rancheria compact was one of these.
In 2016 the Picayune Rancheria of Chukchansi Indians filed a lawsuit against the North Fork Ranchera claiming Gov. Jerry Brown's off-reservation concurrence in 2012 was invalid.
In 2024 a Madera County Superior Court judge agreed with the Chukchansi on that issue and ruled Proposition 28 had nullified Brown's concurrence.
North Fork appealed that ruling, which led to this week's supporting decision by the appellate court. The court wrote:
"Consequently, we conclude the voter's rejection of Proposition 48 included an implied annulment of the Governor's concurrence that rendered the concurrence void ab initio."
"The voter's intent to reject class III gaming on the Madera Site strongly favors treating the concurrence as void ab initio rather than in effect until the election."

North Fork Mono Casino representatives gave the following statement to ABC 30 Action News:
"The state appeals court ruled on a narrow question of state law and expressly did not consider what effect, if any, the 2014 voter referendum had on the 2012 and 2016 federal approvals of the North Fork's project as a matter of federal law. Picayune Rancheria previously challenged each of those approvals in the federal courts and lost conclusively, providing North Fork the right to proceed with its project. North Fork will continue to comply with all applicable law, including the federal laws that govern Indian gaming, as it proceeds with construction of its project to benefit the regional economy and the lives of its more than 3000 tribal citizens."
The North Fork Rancheria Band of Mono Indians are expected to ask the California Supreme Court to hear the case. If unsuccessful, the tribe will likely extend the case from the California courts to Washington DC over the next several years.

The North Fork Mono Casino near Madera, California is expected to open in Fall 2026 now that financing plans for the $750 million construction project have been finalized. North Fork Mono Casino & Resort has been a 20+ year project of the North Fork Rancheria Band of Mono Indians; The tribe has partnered with Station Casinos for development and operational management of the casino resort. Construction of the casino will be completed next year; however, the schedule for construction of the 200-room hotel has not been announced. The North Fork property is located on Highway 99 north of Madera, CA between the Avenue 17 and Avenue 18-1/2 exits. The address is 17770 Golden State Blvd., Madera, CA. North Fork Mono Casino Resort will feature 2,400 slot machines, 40 table games, two full-service restaurants, a food hall, three bars, retail shops, and a parking garage. The financial agreement is between the North Fork Rancheria Economic Development Authority (NFR EDAB), a tribal-owned entity, and a lenders syndicate headed by VICI Properties, a real estate investment trust. Six months ago, the North Fork Rancheria of Mono Indians broke ground for construction of the North Fork Mono Casino & Resort near Madera, California. This week construction crews hoisted the final steel beam into position to complete the building's external framework. This event is a construction milestone called "topping out", which was celebrated by tribal leaders, tribal members and the construction team. Each attendee autographed the beam before it was raised into place.
