Native Hawaiians and Marijuana

Medical Marijuana is Legal in Hawaii

The Hawaii Department of Health administers the Medical Marijuana Dispensary Program. Patients must be issued a 329 Registration Card to legally receive marijuana at any of the eight state-licensed dispensaries.

In 2014 the U.S. Justice Department issued a policy of non-enforcement of the U.S. Controlled Substance Act (CSA) to all federally-recognized Native American tribes. Native Hawaiians are not included in the federal recognition program, and therefore, did not qualify for the DOJ marijuana policy.
