Believed to not be following the Indian Gaming Regulatory Act, last week the
Nooksack Northwood Casino was forced to close.
The Chaudhuri chairman of National Indian Gaming Commission issued the order to
close the casino on June 15. The tribe also had a casino close in December of
2015. That was the Nooksack River Casino.
This is not the only legal problem that the Nooksack Tribe is facing. Nearly 300
people were disenrolled after not being able to provide enough proof to blood
heritage. This is a federal court case.
One of the reasons the casino was closed was due to the tribal management. In
2016 the tribal council for the Nooksack Tribe was not conducting meetings as
outlined in the Nooksack Constitution and Bylaws. Meetings were being held with
members in attendance that had expired terms. Therefore not meeting the required
amount of members needed. Business transactions were occurring that should not
have per the law.
Elections to fill the positions were held in December 2016 and again in January
2017.
Other reasons for the casino closures had to do with not upholding standards
that would maintain the health and safety for guests as well as the environment.
The Environmental Protection Agency submitted orders over problems with the
drinking water. In fact, there were problems with the water at six locations.
One of those locations was Northwood Casino.
Also, the Nooksack Business Corporation II failed to obtain proper licensing for
the Northwood Casino management.
The tribe could receive a penalty of $50,276 per day for each violation until it
is corrected.
The decision can be appealed within 30 days by the tribe.
